4,000 명이 넘는 아티스트들이 예술품 경매로 유명한 크리스티(Christie)에 공개 서한 성격의 항의 메일을 보냈다.  크리스티가 AI를 사용해 제작한 예술품을 경매에 부치려는 계획에 밝혔기 때문이다.  

예술가들은 경매 회사에 보낸 서한에서 판매되는 많은 작품이 라이선스 없이 저작물을 학습한 것으로 알려진 인공지능 모델을 사용해 제작된 것에 대해 '심각한 우려'를 표명했다.

크리스티, 첫 AI작품 경매 논란

크리스티의 첫 AI 아트 경매인 '증강 지능(Augmented Intelligence)'은 주요 경매 회사에서 최초로 인공지능을 활용한 예술가들의 작품을 판매하는 행사다. 경매는 뉴욕에서 열린다.

"These models and the companies behind them are exploiting human artists, using their work without permission or compensation to create commercial AI products that compete with them," the letter said, emphasizing that "supporting these models and the people who use them rewards and encourages AI companies to massively steal the work of human artists."

AI artwork is proliferating across a wide range of artistic disciplines, from film media to music and beyond. While more and more art creators are utilizing AI creation tools, the problem is the behavior of using or training AI without the permission of the original artist.

Christie's inaugural AI art auction, Augmented Intelligence, marks the first time a major auction house will sell works by artists who utilize AI. The auction will take place in New York City.

이에 동조하는 작가들도 있다. NFT 예술 작품 판매로 유명한 비플(Beeple)은 자신의 X에 크리스티 경매를 지지하는 글을 올렸다. 그는 X에 “로봇이 사람을 개처럼 목줄에 묶은 채 경매 포스터를 훼손하는 이미지”를 예술의 전쟁(The art of War)라는 글을 올렸다.

AI art is a growing market segment defined as art created or enhanced by AI tools. Nicole Sales Giles, director of digital art at Christie's, said AI "doesn't replace human creativity, it enhances the human creative spectrum."

Some artists are on board. Beeple, known for selling NFT art, posted on his X in support of the Christie's auction. He posted an image of "a robot defacing an auction poster with a human on a leash like a dog" on X called The art of War.

그는  "저는 예술가들이 이러한 제품을 사용하는 것을 비난하지 않다. 하지만 크리스티가 이러한 작품을 수만, 수십만 달러에 판매하는 것은 AI 제품 뒤에 숨은 착취를 암묵적으로 용인하는 것”이라며 “수많은 예술가들이 바로 이러한 상품으로 인해 생계가 파괴되는 것을 보고 있는 이 시점에 이런 일은 매우 역겹다”고 강조했다.

이번 경매는 AI를 둘러싼 크리에이티브 업계의 복잡한 논쟁을 조명하고 있다 AI의 사용과 이 기술이 창작 과정의 핵심 도구가 될 것인지에 대한 예술가들의 의견이 분분하다.

예술 커뮤니티의 다른 부분에서도 이 판매를 지지했으며, 일부는 청원을 받아들여 단어와 이미지를 사용한 디지털 아트 작품을 제작하기도 했다.

In response to the artists' protest, Christie's said, "The artists in this sale all have strong existing multidisciplinary artistic practices, some of which are recognized in leading museum

collections." He emphasized that the works in the auction are using artificial intelligence to enhance their work. But musician and artist Ed Newton-Rex, one of the signatories to the protest and founder of the nonprofit creators' rights organization Fairly Trained, told Financial Times that AI companies are using other artists' work without permission or compensation.

"I don't criticize artists for using these products. But for Christie's to sell these works for tens or hundreds of thousands of dollars is tacitly condoning the exploitation behind AI products," he said. "It's disgusting at a time when so many artists are seeing their livelihoods destroyed by these very products."

The auction highlights a complex debate in the creative industry surrounding AI, where artists are divided on the use of AI and whether it should become a core tool in the creative process.
Other parts of the art community have also supported the sale, with some responding to the petition by creating digital artworks using words and images.

영국 정부 AI 사용 옵트아웃제 도입 추진

테크놀로지와 예술을 둘러싼 논쟁은 영국 정부의 AI 및 창조 산업에서 최근 뜨거운 화약고다. 영국 정부는 자신의 지적 재산이 무료 AI 학습용 사료가 되는 것을 원하지 않는 경우 권리 보유자가 적극적인 조치를 취하도록 하는 AI 학습용 옵트아웃 저작권 제도에 대해 협의 중이다.

영국 정부는 저작권법 상 면제 조항을 활용, 테크 기업이 '권리 예약(rights reservation” system)' 시스템에 따라 권리자가 반대하지 않는 한 음악, 책, 미디어, 사진 등 저작권이 있는 다양한 자료를 AI 모델 학습에 사용할 수 있도록 허용할 예정이다. 저작권법의 예외 조항을 활용하겠다는 이야기다.

저작권 소유자들에게는 권리 유보(rights reservation) 시스템을 통해 이를 거부할 수 있는 선택권을 준다. 이 접근 방식은 AI 개발자들에게 광범위한 데이터에 대한 접근을 허용하면서도, 저작권 소유자들이 자신의 작품 사용을 통제하고 보상받을 수 있는 균형을 맞추려는 시도다.

그러나 이러한 계획에 대해 음악, 영화 제작, 예술 및 미디어 업계에서는 '옵트아웃' 시스템이 비용이 많이 들고 단속이 어려울 수 있다는 점에서 우려를 표하고 있다. 현재 영국 정부는 이 조항 개정에 대한 의견 수렴을 2025년 2월 25일까지 받고 있다.

The debate surrounding technology and art is the latest hot potato in the UK government's AI and creative industries. The UK government is consulting on an opt-out copyright regime for AI learning that would require rights holders to take active steps if they don't want their intellectual property to become fodder for free AI training.

By utilizing an exemption in copyright law, the UK government would allow tech companies to use a range of copyrighted materials, including music, books, media, photos, and more, to train AI models under a "rights reservation" system, unless the rights holder objects. The idea is to take advantage of an exception to copyright law. Copyright holders will be given the option to opt out through a rights reservation system. This approach attempts to strike a balance between giving AI developers access to a wide range of data, while allowing copyright holders to control and be compensated for the use of their work.

However, the music, filmmaking, arts, and media industries have concerns about these plans, noting that "opt-out" systems can be costly and difficult to enforce. The UK government is currently accepting comments on the proposed changes until February 25, 2025.

한편, 크리스티는 경매에 출품된 대부분의 작품에 대해 암호화폐 결제를 허용할 예정이다.

지난 2024년 11월 AI 로봇이  작품이 경매에서 최고가를 기록하기도 했다. 휴머노이드 로봇인 Ai-Da가 만든 이 그림은 소더비에서 100만 달러 이상에 낙찰됐다.

Meanwhile, Christie's will accept crypto payments for most of the works up for auction. In November 2024, an AI robot sold a painting for the highest price at auction.

The painting, created by the humanoid robot Ai-Da, sold for more than $1 million at Sotheby's.
