“Sorry, TikTok isn't available right now”

틱톡(TikTok)의 서비스가 미국에서 동부 시간 1월 18일 오후 10시 30분 중단됐다. 미국 내 1억 7,000만 명의 틱톡 이용자들은 ‘서비스를 지금 이용할 수 없다는 메시지(services temporarily unavailable)를 받기 시작했다. 구글과 애플의 앱스토어에서도 20일 자정을 기해 앱이 사라졌다.

이용자 1억 명이 넘는 메이저 서비스가 강제로 삭제되기는 이번이 처음이다.  모회사(바이트댄스)가 미국의 적대국 중국인 틱톡이 주주를 다양화하지 않으면 미국 내에서 영업을 하지 못하게 하는 법안에 정한 시한(1월 19일)이 지났기 때문이다. 다만, 바이든 대통령은 법 집행을 명하는 서류에 서명을 거부했고 차기 대통령(1월 20일)인 트럼프 대통령에게 결정권이 넘어갔다. 틱톡도 서비스 중단을 알리면서 "트럼트 대통령이 틱톡 계속 영업을 위해서 노력하고 있다"고 밝혔다.

TikTok went down at 10:30 p.m. ET on Jan. 18 in the United States.

TikTok's 170 million users in the U.S. began receiving messages stating that the service was temporarily unavailable. The app also disappeared from Google and Apple's app stores at midnight on January 20th.

This is the first time a major service with more than 100 million users has been forced to shut down.  This is because TikTok's parent company (Bytedance) missed a Jan. 19 deadline set by legislation that would have prevented it from operating in the U.S. if it did not diversify its shareholders from China, a U.S. adversary.

However, President Biden refused to sign the paperwork to enforce the law, leaving the decision to incoming President Trump (Jan. 20). TikTok also announced the shutdown, saying, "President Trump is working to keep TikTok open for business."

트럼프는 취임 이후  틱톡을 계속 유지하려고 노력할 것이라고 밝혔지만, 막대한 벌금에 직면한 구글과 애플 등 앱스토어 운영 빅테크들은 법 위반의 위험을 감수하지 않기로 결정한 것이다.

틱톡은 앱 스토어 운영자와 미국에서 틱톡(TikTok) 백엔드를 운영하는 오라클과 같은 클라우드 서비스 공급업체의 경우, 금지 조치에 복잡하게 얽혀있다.

지난 1월 17일 미국 대법원(Supreme Court)은 틱톡 금지를 담은 법안을 유지키로 결정했다. 하지만, 미국 의회에서는  금지령의 기한을 연장할 방법을 찾아야 할지 아니면 미국 구매자를 찾지 못하면 틱톡의 미국 진출을 막아야 할지에 대해 의견이 분분하다. 미국에서 틱톡이 계속 영업을 하기 위해선 금지령 집행 기한을 늦추고 그 사이에 매수자를 찾거나 다른 법안이 발의돼 법적 중단을 면하는 것이다.  트럼프는 행정 명령을 내리거나 법무부 장관에게 법 집행을 하지 말라고 요청할 수도 있다.

트럼프 법 집행 90일 연장

차기 대통령은 트럼프(Trump)는 이미 데드라인을 90일 연장하는 쪽으로 가닥을 잡은 것으로 알려졌다. 하지만, 이 조치가 틱톡의 지배주주를 미국 기업으로 바꾸는 중이라는 것을 증명해야 한다. 즉 미국 소유주에게 틱톡을 매각하기 위한 법적 구속력이 있는 협상이 진행 중이라는 것을 보여줘야 한다는 이야기다.

현재 틱톡 인수에 관심을 가지는 기업들은 플랭크 맥코트(Frank McCourt) 미국 부동산 재벌, AI검색엔진 퍼플렉서티 등 상당히 많다. 맥코트는 미국 버전의 틱톡은 전체 매출의 약 8%, 사용자 기반의 8% 미만이라고 주장하며 바이트댄스 전체 가치에서 차지하는 비중은 극히 일부에 불과하다고 말했다. 하지만 관건은 매각이  중국 정부의 승인을 받아야 한다는 것이다. 틱톡의 미국 자산은 20억 달러에서 100억 달러에 달한다는 평가를 받고 있다. 현재 바이트댄스의 기업 가치는 3,00억 달러 이상이다.

맥코트는 틱톡의 알고리즘과 미국인들의 개인 정보를 미국에서 관리할 수 있게 하는 돈과 기술을 보유하고 있다고 밝혔다. 맥코트는 수년 전 소비자가 자신의 사용자 데이터를 소유할 수 있는 기술로 ‘프로젝트 리버티’를 출범시켰다.  그는 1월 17일 현재 150만 명 이상의 사용자를 보유한 이 "깨끗한 미국산 기술"에 5억 달러 이상을 투자했다고 말했다.

For app store operators and cloud service providers like Oracle, which runs TikTok's backend in the U.S., the ban is complicated.

On January 17, the U.S. Supreme Court voted to uphold the ban on TikTok. However, the U.S. Congress is divided on whether to find a way to extend the ban or block TikTok from entering the U.S. if it can't find a U.S. buyer. For TikTok to continue operating in the U.S., it would have to find a buyer in the meantime or pass another bill to avoid a legal shutdown.  Trump could also issue an executive order or ask his attorney general not to enforce the law.

The president-elect has already reportedly leaned toward extending the deadline by 90 days. However, this action would require TikTok to prove that it is in the process of changing control to a U.S. company, meaning it would have to show that legally binding negotiations are underway to sell TikTok to a U.S. owner.

Currently, there are a number of companies interested in acquiring TikTok, including American real estate mogul Frank McCourt and AI search engine perplexity. McCourt claims that the U.S. version of TikTok accounts for about 8% of total revenue and less than 8% of the user base, making it a tiny fraction of Bytedance overall value.

The key, however, is that the sale must be approved by the Chinese government. TikTok's U.S. assets are valued at $2 billion to $10 billion. Bytedance is currently valued at more than $300 billion.

McCourt said the company has the money and technology to keep TikTok's algorithms and Americans' personal information under U.S. control. McCourt launched Project Liberty several years ago as a technology that would allow consumers to own their user data.  He said he has invested more than $500 million in this "clean, American-made technology" that had more than 1.5 million users as of Jan. 17.
