중국 기업 바이트댄스(ByteDance)가 대주주인  동영상 공유 플랫폼 틱톡(TikTok)의 미국 내 사업이 ‘틱톡 금지법’에 따라 매각 위기에 처하자, 이를 인수하려는 기업들의 경쟁이 치열하게 벌어지고 있다. 틱톡 금지법은 미국 연방의회가 2024년 4월에 제정한 법안으로,  미국에 적대적인 국가인 중국의 기업 바이트댄스가 주주인 틱톡의 미국 내 사용을 제한하는 내용을 담고 있다.

연방 외희는 틱톡이 미국인 개인 정보를 대규모로 수집해 중국 정부에 넘기거나 중국이 틱톡을 통해 미국 여론에 부당한 영향력을 행사할 수 있다고 우려하고 있다.

법은 바이트댄스에 틱톡의 미국 사업권을 미국 기업에 매각하라고 명령했고 매각이 이루어지지 않을 경우, 2025년 1월 19일부터 미국 내에서 틱톡 서비스를 금지하도록 규정했다. 틱톡은 이 법이 미국인의 표현의 자유를 침해한다며 반발하고 있으며, 법원에 소송을 제기했지만 1, 2심에서 패소했다.

2025년 1월 19일부터 틱톡 금지법이 발효되어 미국 내 서비스가 중단됐다. 그러나 도널드 트럼프 대통령이 취임 후 이 법의 시행을 75일간 유예하는 행정 명령을 공포했다. 그러나 이 기간 바이트 댄스는 미국 사업 인수자를 찾지 못하면 전국적인 사용 금지 조치에 직면할 수 있다. 트럼프 대통령은 30일 내 인수자를 찾겠다고 밝혔다.

도날드 트럼프 대통령은 틱톡 금지 유예를 발표하면서 미국 사업 운영을 위한  미국 기업과 합작사 설립(50대 50)을 바이트댄스에 제안하기도 했다.

틱톡의 인수를 원하는 기업들은 소유주인 바이트댄스사와 중국과의 관계에 대한 정부의 국가 안보 우려를 충족시켜야 한다. 지금까지 이 회사는 이 문제를 해결하지 못했다.

바이트댄스가 틱톡을 매각할지 여부는 불분명하다.  바이트댄스는 지난 2024년에만 500억 달러 이상의 매출을 올린 틱톡의 매각을 거부해왔다.  바이트댄스 이사회 멤버이자 제너럴 아틀란틱(General Atlantic_의 CEO인 빌 포드는 블룸버그에  "매각을 하지 않아도 되는" 해결책이 있을 수 있다고 말했다.(there may be solutions “short of having to sell)

또한 트럼프의 데드라인 연장 행정 명령이 법률 심사를 통과할 수 있을 지도 미지수다. 국가보안법(national security law)에 따르면 매각 절차 연장은 이미 거래가 진행 중인 경우에만 허용되며, 그러한 합의는 발표되지 않았다.

The video-sharing platform TikTok, whose majority shareholder is Chinese company ByteDance, is facing a potential sale of its U.S. operations under the "TikTok Ban Act," sparking a fierce bidding war. The TikTok Ban Act was enacted by the U.S. Congress in April 2024, restricting the use of TikTok in the U.S. because it is owned by Bytedance, a Chinese company that is hostile to the United States.


Federal officials are concerned that TikTok may be collecting personal information about Americans on a large scale and turning it over to the Chinese government, or that China may be using TikTok to unduly influence U.S. public opinion.


The law ordered Bytedance to sell TikTok's U.S. operations to a U.S. company, and if that doesn't happen, it banned TikTok in the U.S. starting Jan. 19, 2025. TikTok argued that the law violated Americans' freedom of expression and challenged the law in court, losing in the first and second rounds.


On January 19, 2025, the TikTok Ban Act went into effect, shutting down the service in the United States. However, after President Donald Trump took office, he issued an executive order suspending the law for 75 days, during which time Byte Dance could face a nationwide ban if it does not find a buyer for its U.S. business. President Trump has said he will find a buyer within 30 days.


In announcing the TikTok ban, President Donald Trump also offered ByteDance a 50/50 joint venture with a U.S. company to run its U.S. operations.


Any company that wants to buy TikTok would have to satisfy the government's national security concerns about its owner, Bytedance, and its ties to China. So far, the company has not been able to resolve this issue.

It's unclear whether Bytedance will sell TikTok.  Bytedance has previously refused to sell TikTok, which generated more than $50 billion in revenue in 2024 alone.  Bill Ford, Bytedance board member and CEO of General Atlantic, told Bloomberg that there may be solutions "short of having to sell." It's also unclear whether Trump's executive order to extend the deadline will pass legal muster. Under national security law, extending the sale process is only allowed if a deal is already in the works, and no such agreement has been announced.

틱톡 인수를 희망하는 기업들은 상당히 많다. 미국에서만 1억 7,000만 명이 사용한 슈퍼 앱이기 때문이다.

트럼프는 틱톡 매각에 자신하고 있다. 그러나 틱톡의 매각은 모든 단계에서 승인을 받아야 하며 국가 안보 우려도 충족시켜야 한다.  그렇다면 누가 틱톡을 인수할까?

There's no shortage of companies looking to acquire TikTok. It's a super app with 170 million users in the US alone.


Trump is confident about selling TikTok. However, the sale of TikTok would have to be approved at every step of the way, and it would also have to satisfy national security concerns.  So who would buy TikTok?
